Lasting Power of Attorney (Fremtidsfullmakt)

Fill in the form and get a Norwegian fremtidsfullmakt as a ready-to-sign PDF, with the witness section and a signing checklist.

Created in your browser
Not legal advice. Tools-Bench writes the document from what you enter, but cannot judge whether it suits your situation. The PDF is not valid on its own: it becomes a fremtidsfullmakt only when you sign it on paper while two qualified witnesses are present together (vergemålsloven § 81). If your situation is complicated, talk to a lawyer.
The document is in Norwegian, because banks, Kartverket and Statsforvalteren read it in Norwegian. The signing checklist on its first page is in English. Nothing you type leaves this device. The PDF is created in your browser and nothing is saved.

You, the person giving the power of attorney

You must be 18 or older and understand what the fullmakt means (§ 79).

Optional

Your fullmektig

The person or people who will act for you. A fullmektig must be 18 when the fullmakt takes effect, must not be under guardianship, and must be a person, not a firm (§ 79). Ask them first whether they are willing.

Fullmektig 1
Optional
Optional

Substitute (optional)

Steps in if a fullmektig is temporarily or permanently unable to act (§ 79). Years can pass before a fullmakt is used, so naming a substitute is worth it.

When should it apply?

A pure fremtidsfullmakt. Your fullmektig decides when your health means it has taken effect, and must then tell you and your spouse or cohabitant, or your closest relatives (§ 83).

What it covers

Statsforvalteren often sees fullmakter that cover too little, so a guardian is needed later anyway. Narrowing it is fine — as long as it's a deliberate choice.

Optional
Optional

Gifts and advances on inheritance

By law a fullmektig may give customary gifts, like birthday and Christmas presents. Any other gift, including an advance on inheritance, must be written into the fullmakt (§ 87).

Birthdays, Christmas and similar occasions — what the law allows by default.

Terms

Expenses and payment

Necessary expenses from your funds, and a reasonable fee when that is fair (§ 88).

Optional

Witnesses (can wait until the signing)

Enter your two witnesses to check that they qualify and have their details printed — or leave this blank, and they fill in their lines by hand when you sign.

Witness 1
Printed in Norwegian on the witness line, e.g. "nabo". It shows the witness is impartial.
Witness 2
Printed in Norwegian on the witness line, e.g. "nabo". It shows the witness is impartial.

Signing

Optional
The day you will actually sign. Leave blank to write it by hand. Ages are checked against it.
Several signed originals let you and your fullmektig keep one each. A copy can't be used for stadfesting.

About the Lasting Power of Attorney (Fremtidsfullmakt)

A fremtidsfullmakt is the Norwegian lasting power of attorney. It lets you decide who will look after your interests if you one day can't — because of dementia, another mental illness or seriously failing health. It can replace guardianship (vergemål) in whole or in part, and the person you choose acts on your instructions, instead of a guardian appointed by Statsforvalteren.

The rules are in chapter 10 of vergemålsloven, the Guardianship Act. The fullmakt must be in writing and say clearly that it applies once you can no longer look after your interests. You sign it while two witnesses are present together, and they sign while you are present. The witnesses must be 18 or older, and neither the fullmektig nor the fullmektig's spouse, cohabitant, parents, children or grandchildren may witness. If these rules are broken, the document is not valid as a fremtidsfullmakt.

This form writes the document for you, in Norwegian, with the wording the official guidance asks for: who may do what, whether your home may be sold, which gifts are allowed, and a witness statement confirming you acted freely and understood what you signed. It checks your witnesses against the rules before you print. Everything happens in your browser — names and dates of birth are never sent to a server.

What the form can't do is decide what is right for you. Statsforvalteren often sees fullmakter that only cover selling the home and paying bills, while the need later turns out to be greater. Think through what you want, talk to the people you choose, and see a lawyer if your situation is complicated — for example with children from an earlier relationship, a business, or disagreement in the family.

How to use the form

1
Fill in yourself and your fullmektig
Name one or more people you trust, and a substitute in case one of them can't act.
2
Choose what it covers
Financial matters, personal matters or both — and whether your home may be sold and which gifts are allowed.
3
Check your witnesses
Optional: enter your two witnesses, and the form tells you whether they qualify.
4
Create and print the PDF
It's made in your browser. Read it through, and change things in the form rather than by hand.
5
Sign with both witnesses present
Follow the checklist on the first page. The fullmakt is valid only once it is signed and witnessed correctly.

Frequently asked questions

Who can witness a fremtidsfullmakt?
Witnesses must be 18 or older and understand what signing means. The fullmektig can't be a witness, and nor can the fullmektig's spouse, cohabitant, parents, children or grandchildren (vergemålsloven § 81). Sivilforvalteren also advises against witnesses with an interest of their own, and calls your children or the fullmektig's siblings often an unfortunate choice. A neighbour, friend or colleague is usually a safe choice.
Do both witnesses have to be there at the same time?
Yes. Both witnesses must be present together when you sign, or confirm your signature, and they must sign while you are present. Witnesses signing separately later is not enough. They must know the document is a fremtidsfullmakt, but don't need to know what it says.
Do I need a medical certificate to create a fremtidsfullmakt?
No, the law doesn't require one when the fullmakt is created. If your memory has started to fail, Statsforvalteren still recommends a doctor's confirmation that you understand what the fullmakt means, so there is no doubt later. When the fullmektig asks Statsforvalteren to confirm the fullmakt (stadfesting), a medical certificate about your health at that time is required.
Can I sign a fremtidsfullmakt with BankID?
No. The fullmakt can be written on a computer, but you and the witnesses must sign it physically, on paper. Statsforvalteren does not accept a fully digital fremtidsfullmakt with electronic signatures.
Does a fremtidsfullmakt have to be registered or sent to Statsforvalteren?
No. There is no register, and Statsforvalteren can't approve one in advance. Keep the original safe and tell your fullmektig where it is. Only once the fullmakt has taken effect can the fullmektig ask Statsforvalteren to confirm it.
When does a fremtidsfullmakt take effect?
When dementia or another mental illness, or seriously failing health, means you can no longer look after your interests in the areas the fullmakt covers. The fullmektig judges this, and must then notify you and your spouse or cohabitant, or your closest relatives (§ 83). Confirmation by Statsforvalteren is optional, but Kartverket and many banks require it.
Can my fullmektig sell my home?
Only if the fullmakt says so. Kartverket won't register a sale made under a fremtidsfullmakt unless the right to dispose of real estate is written into it and Statsforvalteren has confirmed it. The form writes that right in when you tick the property option.
Can the fullmektig give gifts or advances on inheritance?
The fullmektig may give customary gifts, such as Christmas and birthday presents. Any other gift, including an advance on inheritance, can only be given if it is written into the fullmakt (§ 87). Say who gets what, and on what occasion.
Is the PDF a valid fremtidsfullmakt?
Not on its own. It becomes a valid fremtidsfullmakt only once you have signed it on paper while two qualifying witnesses were present together — and only if you understood what it meant when you signed. Follow the checklist on its first page. This is not legal advice.
What is the difference between a fremtidsfullmakt and a continuing power of attorney?
An ordinary power of attorney lapses if you become too ill to look after your interests. A continuing power of attorney (vedvarende fullmakt) applies from the day you sign, like an ordinary one, and carries on as a fremtidsfullmakt afterwards. It must meet the same formal requirements as a fremtidsfullmakt.
